This agreement is by and between Toni Perdew, hereinafter referred to as Stallion Owner and/or Manager and ________________________________, hereinafter referred to as Mare Owner. Stallion Owner hereby agrees to attempt to breed the Quarter Horse Stallion, _____________________________, to the following mare which is owned or leased by Mare Owner during the breeding season of ________ for a fee.   Negative Coggins and clean culture required upon presentation of the mare for breeding.  Clean culture not required if mare has a foal less than 30 days of age at side.

Describe any information Stallion Owner should know about mare/foal in order to have a successful breeding and a safe experience:

The stud fee for the 2006 breeding season is $___________ plus mare care and any necessary vet charges.

The stud fee, less any prepaid fees, and applicable boarding/handling/veterinary, etc. fees shall be charged and are due and payable before the aforestated mare leaves the Stallion Owner property.  

Should the aforestated mare fail to deliver a live foal (one that lives for 24 hours or more post-partum), the mare will be rebred without charge of additional stud/booking fees the following year IF Stallion Owner was informed of the situation within two weeks of the birth of the dead foal (including veterinary statement), or by expected foaling date in the case of an open mare.  Applicable mare care fees will apply for any rebreeding at $6.00 per day, dry.

A nonrefundable boarding fee of $6.00/dry and $8.00/wet will shall be charged to Mare Owner by Stallion Manager for each day aforestated mare (and foal) is/are at the Stallion Owner's. Said boarding fee shall be paid before aforestated mare (and foal) leave the Stallion Owner.

Stallion owner agrees to diligently attempt to settle mare.  Should the mare appear to be a danger to the stallion, stallion owner, or to herself, the stallion owner may refuse the mare.  Applicable boarding fees will be paid by the Mare Owner.  If mare was never covered, the stud fee will be refunded LESS a $50 handling fee or boarding fees, whichever is greater.  Should mare fail to settle within two cycles, mare owner should provide evidence of a clean culture, at mare owner’s expense, by a certified veterinarian before Stallion Owner attempts to breed the mare again.  

Any additional veterinary and farrier fees shall be charged to Mare Owner by Stallion Owner for appropriate services for aforestated mare (and foal). Mares with shoes on hind feet will have shoes removed at mare owner’s expense. Stallion Owner will be held blameless for any claim resulting from the accidental death or injury to the mare/foal from these actions.  Mares that are difficult to handle may be returned to Mare Owner, unbred. Board/booking fees shall be paid before said mare (and foal) leaves the Stallion Owner.

Mare Owner hereby agrees that Stallion Owner reserves the right to refuse service to any mare which appears to be diseased, unruly, dangerous, or which is unfit for breeding in the opinion of the Stallion Owner (example:  overbite, poor conformation, venereal disease, aggressive toward handler or stallion, etc.). Stallion owner does require a current negative Coggins test, as well as a clean culture on all mares except those with foals under 30 days of age.

It is agreed by the parties hereto that if the aforestated stallion should die, be sold or become unfit for breeding before serving aforestated mare, or if aforestated mare should die, be sold or become unfit for breeding before served, this agreement is and shall be null and void with the exception of boarding fees, which still apply. A new agreement for a different stallion is an option, as is refund of the stud fee.

Mare Owner hereby agrees to hold Stallion Owner harmless from any claim resulting from accidental injury, illness, or death of aforestated mare (and foal).  Mare Owner understands that breeding can be cause for accidents, and assumes risk for such accidents to mare (and foal).  Mare Owner has accepted Stallion Owner's facilities and caregiving ability, and deems them adequate.

Stallion Owner hereby agrees to hold Mare Owner harmless from any claim resulting from damage or injury by aforestated mare (and foal).

Stallion Owner hereby agrees to maintain aforestated mare (and foal) in suitable facilities and feed pursuant to this agreement, with proper care, handling and protection, according to the rules of good animal husbandry and reasonable standards and practices of the local horse industry.  Stallion owner might employ the use of a breeding stock, breeding hobbles, twitch, tranquilizer, or other restraint device commonly accepted in handling practices, if necessary, unless specifically refused by mare owner.  Mare may be live covered or artificially inseminated, to be determined by Stallion Owner.

Stallion Owner hereby agrees that Mare Owner may go upon Stallion Owner's premises to visit or inspect aforestated mare (and foal) and determine if same is in good health and being properly care for.

Stallion Owner agrees to properly report the breeding to the appropriate breed registry for approval in order to allow Mare Owner or Mare Owner Agent to register the resulting foal the year after the breeding. If the mare is not AQHA registered, Mare Owner may pay fees necessary to cause the mare’s registration association to register the foal.

Mare Owner agrees to pick mare up in a timely manner.  IF ARRANGEMENTS ARE NOT MADE TO PICK UP MARE (AND FOAL) AND TO PAY ALL INCURRED EXPENSES WITHIN 90 DAYS, THE AFORESTATED MARE (AND FOAL) WILL BE CONSIDERED ABANDONED AND MAY BE SOLD. UPON THIS EVENT, THE OWNER AGREES TO TRANSFER THE REGISTRATION PAPERS TO THE STALLION OWNER OR BUYER OF THE ABANDONED MARE/FOAL. Exception would be where Mare Owner and Stallion Owner reach agreement for boarding for excessive time period.

This agreement and all covenants and agreements herein contained shall accrue to and be binding upon the parties hereto, their heirs, successors, administrators, and executors. Upon material breach of this agreement by one party, the other party may terminate same. No modification of this agreement shall be binding unless in writing and executed by all parties hereto. This agreement is subject to the laws of the state of Iowa, executed on _________________________________ (date).
